The Midwestern Bankruptcy Institute and Consumer Forum was held in September at the University of Missouri-Kansas City. There were two sessions of interest to the committee at the conference. First, "Case Law Update: 'Yours, Mine and Ours'" offered attendees updates from the Eighth and Tenth Circuits, and the Supreme Court on topics such as property of the estate, a trustee's rights after avoiding liens and post-confirmation modifications, as well as several case studies. The Eighth Circuit update was provided by Hon. Barry S. Schermer of the U.S. Bankruptcy Court for the Eastern District of Missouri in St. Louis; the Tenth Circuit update was provided by Hon. Robert E. Nugent of the U.S. Bankruptcy Court for the District of Kansas in Wichita; the Supreme Court update was provided by Hon. Arthur B. There was also a session titled "Intercreditor Agreements and their Impact on the Chapter 11 Process," which covered topics such as second lien financings, adequate protection, confirmation requirements and postpetition interest. The speakers also provided attendees with related ABI Journal articles. Panelists included Mark N. Berman of Nixon Peabody LLP in Boston, David K. Bowsher of Adams and Reese LLP in Birmingham, Ala., Jonathan P. Friedland of Levenfeld Pearlstein, LLC in Chicago and Shawn C.A. Hassel of Alvarez & Marsal in Phoenix. ABI's and Georgetown Law CLE's Views from the Bench was held at the Georgetown University Law Center in Washington D.C. in September, and a set of the event's educational materials will prove to be an interesting read to the committee. The session was titled "Sales in Bankruptcy: Is Everything Now a Sale? Credit-bidding as the new structural device, equitizing debt as part of the credit bid and Philadelphia Inquirer, break-up fees and substantial contribution claims, plan-support agreements, Innkeepers." Robert J. Rosenberg of Latham & Watkins, LLP in New York moderated the session and Gary T. Holtzer of Weil, Gotshal & Manges LLP in New York acted as the facilitator. Panelists included Hon. Stuart M. Bernstein and Hon. Arthur J. Gonzalez, both of the U.S. Bankruptcy Court for the Southern District of New York in New York City, and Hon. Peter J.
