Materials From the 28th Annual Midwestern Bankruptcy Institute
The 28th Annual Midwestern Bankruptcy Institute, held in Kansas City, Mo. on October 3, 2008, proved to be another successful partnership between the American Bankruptcy Institute and the UMKC School of Law. The meeting upheld its well-earned reputation by featuring distinguished speakers on a number of current bankruptcy topics. Two programs of particular interest were the "Case Law Update" and "Nonbankruptcy Business Alternatives."
The Plenary session on recent case law updates covered topics ranging from absolute priority in chapter 11 to the "hanging paragraph" and plan confirmation in chapter 13. The panel provided viewpoints from both academia and the courts and included Hon. Dennis R. Dow, U.S. Bankruptcy Court (W.D. Mo.), Hon. Robert E. Nugent, U.S. Bankruptcy Court (D. Kan.), Prof. G. Ray Warner, St. John's University School Of Law in Jamaica, N.Y. and Prof. Jack F. Williams, ABI Resident Scholar. In the session "Nonbankruptcy Business Alternatives," the panel discussed a number of options for distressed companies including sale by debtor, secured party foreclosure, receivership, among others. The panel for the session included Mark Bossi of Thompson Coburn LLP in St. Louis, Mo., Daniel C. Cohn of Cohn, Whitesell & Goldberg LLP in Boston and Douglas M. Neeb of Dickinson Financial Corp. in Kansas City, Mo.
