Online Features of Interest to Consumer Bankruptcy Committee
Members
A press
briefing on child support claims under the proposed Bankruptcy Reform
Act, hosted by ABI on Friday, March 28, is now available online. The third
in a series of press
educational teleseminars, the briefing featured ABI experts addressing
timely issues in consumer and corporate bankruptcies. The treatment of
child support claims in bankruptcy continues to be one of the most controversial
aspects of the bankruptcy reform bill. A balanced panel of experts, including
Philip Strauss, National Child Support Enforcement Association, Karen
Cordry, National Association of Attorneys General, Joan Entmacher, National
Women’s Law Center and Linda Lea Viken, American Academy of Matrimonial
Lawyers, discussed the merits.
The upcoming
June issue of the ABI
Journal will feature an article by David Wheeler (Moore & Van
Allen PLLC; Charleston, S.C.) titled, "Lien ‘Revival’
Under §349: In re Booth.” Also featured are articles on two
perspectives on the landmark District Court opinion casting doubt on payments
to critical vendors under the doctrine of necessity, what's next under
Section 525 after the Supreme Court's NextWave opinion, and how to do
a "dirt-for-debt" swap under Section 1129(b)(2)(A). Also featured
are profiles of ABI's 10 new members of the Board of Directors, and more.

A
simple bill to create a single federal
district judgeship in Idaho ballooned
in the Senate Judiciary Committee
last Thursday into a measure creating
50 new judgeships. The panel approved
the expansion of the federal judiciary
in an 18-0 [vote] as a substitute
to the original measure. The bill
(S. 878) goes to the floor at a time
the Senate is already bogged down
in a Democratic filibuster blocking
two of President Bush's presidential
nominations for judgeships. By agreement,
the committee took up the amended
substitute version by Sen. Dianne
Feinstein (D-Calif.), adding a total
of 14 new judgeships, including the
Idaho post. An amendment by Sen. Joseph
Biden (D-Del.) was approved to create
36 new permanent bankruptcy judges
in New York, Delaware, New Jersey,
Pennsylvania, Maryland, North Carolina,
South Carolina, Virginia, Michigan,
Tennessee, Arkansas, Nevada, Utah,
Florida and Georgia. The amendment
would also add one temporary judgeship
each in Puerto Rico, New York, Pennsylvania,
Maryland, Mississippi and Georgia.
