Beware: Could Your Right to Possession Be in Jeopardy Due to Your Landlord's
Bankruptcy?" by Steven B. Towbin. Since at least 1978, when the
Bankruptcy Code was enacted, lessees of real property could feel secure
that even if their landlord filed for protection under chapter 7 or 11
of the Code, their right to continue to occupy their leased premises was
protected as long as they continued to pay rent and otherwise perform
under the lease. That may have changed due to the Seventh Circuit's decision
in Precision Industries Inc. v. Qualitech Steel SBQ LLC (In re Qualitech
Steel Corp.), ____ F.3d ____, 2003 WL 1918405 (7th Cir. 2003).
