ABI’s Annual Spring Meeting: Committee Educational Session

The Health Care Committee leadership invites and urges all members of the committee to attend the ABI’s 26th Annual Spring Meeting at the Renaissance Hotel in Washington, D.C. on April 3-6, 2008.  Don’t miss the cherry blossoms!  More importantly don’t miss the Health Care Committee panel.  This Spring’s panel will focus on the disposition of the assets of distressed health care entities both inside and outside bankruptcy.  Health care entities considered will include hospitals, SNF’s, and assisted living facilities.  The panelists will include bankers, bankruptcy attorneys and other business professionals.  Given the possibility of a recession and the movement in many states to “rationalize” the delivery of health care, the panel’s discussion will be both interesting and timely. 

 

Materials from the “Health Care Cases: Financing, Financial Management and Exit” Panel at the Winter Leadership Conference

More than 600 insolvency professionals from 41 states and five countries attended the 19th Annual Winter Leadership Conference in Rancho Mirage, Calif. Nearly 12 hours of CLE/CPE was provided through panel programs and committee educational sessions. The educational programs, designed by ABI Vice President-Education Robert J. Keach (Bernstein Shur; Portland, Maine), were very well-received.

The panel on "Health Care Cases: Financing, Financial Management and Exit", moderated by Samuel R. Maizel, of Pachulski Stang Ziehl & Jones LLP, explored the financing, financial management and exit strategies available for today’s restructuring professionals. The panel included: Paul E. Harner of Paul, Hastings, Janofsky & Walker LLP, Shane A. Passarelli of Healthcare Finance Group, Inc., Todd M. Patnode of Bridge Associates LLC and Joseph Tutera of The Tutera Group. Committee Meeting Minutes from the Winter Leadership Conference


The committee met at the Winter Leadership Conference at the Westin Mission Hills Resort in Rancho Mirage, Calif., on Dec. 7, 2007 from 3:15- 5:15. A forum was created to network with other committee members about health care issues.  A roundtable discussion about cutting- edge current health care topics was discussed.  Each member was encouraged to participate.  We polled the membership and these were the topics that YOU selected:

1. The impact of the new BAPCPA provisions on sales of non-profits (Bankruptcy Code Sections 363(d)(1) and 1129(a)(16).

2. Members’ experience with self-insurance of health care claims.

3.  Members’ experience with the interplay of state court receiverships and subsequent bankruptcies.

4.  Members’ experience with the new ombudsman provisions.
