Materials From The 10th Annual New York City Bankruptcy Conference
The 10th Annual New York City Bankruptcy Conference, held May 12, featured a great mix of hot topics in bankruptcy including subprime issues, the ABI fee study, rights offerings, the changing players in chapter 11, and more. In one such session a panel discussed the recent trends in international restructurings. Corinne Ball of Jones Day moderated the panel which included Evan C. Hollander of White & Case LLP, Hon. Burton R. Lifland, U.S. Bankruptcy Court, Southern District of New York, Deryck A. Palmer of Cadwalader, Wickersham & Taft LLP and Joseph Samet of Baker & McKenzie LLP. Included in the materials for the session was a paper by Mr. Samet entitled "Basics of Chapter 15," which includes a summary of the Code sections. Also included in the materials was a summary of two recent bankruptcy court decisions by Judge Lifland regarding two hedge funds affiliated with Bear Stearns. In both cases, the court denied the hedge funds' requests for chapter 15 recognition. The summary was written by Ms. Ball, Brad B. Erens, Jayant W. Tambe, and Mark G. Douglas, all from Jones Day.
