Policy Debate: Is BAPCPA Effective at Achieving Its Intended Goals and Objectives?

The intended goals and objectives expressed in Congress have always been clear: reduce the rising volume of consumer bankruptcy filings and have consumer debtors who do file for bankruptcy pay more to their creditors. If the discussion is limited to “intended” goals and objectives, the answer is brief and easy: No! If the discussion moves to measuring intention by actions rather than words—by studying the legislative choices, by analyzing outcomes and consequences—then the issues become more subtle, complex and murky.

Minutes from the 2006 Winter Leadership Conference

The Legislation Committee meeting was a joint meeting with the Court Administration Committee represented by Lynn Tavener. The presentation by the Legislation Committee was jointly given by Scott Williams and Judge Jim Gregg. The committee chairs gave presentations on the process of the appointment of bankruptcy judgeships and related practical considerations. The historical and statutory background related to the appointed of judgeships was also discussed. The Court Administration Committee discussed issues on the upcoming Revised Bankruptcy Rules, as well as the current ABI Rules Survey. The Committee meeting ended with open discussion of participants concerning the changes expected in the new Congress and upcoming legislative priorities.
