The Legislative Committee presented a “reprise” panel discussion that addressed pending legislation in Congress, specifically bills that would redefine the treatment of home mortgages in bankruptcy. Participating on the panel were Susan Jensen-Lachmann, who serves on the staff of Rep. John Conyers (D-Mich.), House Judiciary Committee Chairman, and David Lachmann, who serves on the staff of Rep. Jerrold Nadler (D-N.Y.), a member of the House Judiciary Committee. Moderating the panel was Hon. David W. Houston III of the U.S. Bankruptcy Court for the Northern District of Mississippi. The panel primarily addressed the “Emergency Home Ownership and Mortgage Equity Protection Act of 2007”—H.R. 3609—which prompted a spirited discussion from the audience members attending the program. The primary points of this legislation, which has been labeled as the Conyers-Chabot Compromise, are set forth below.

Included is the recent Hearing on H.R. 4044: To amend the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 to exempt from the means test in bankruptcy cases, for a limited period, qualifying reserve-component members who, after September 11, 2001, are called to active duty or to perform a homeland defense activity for not less than 60 days by the House Judiciary Subcommittee on Commercial and Administrative Law.
