At the VALCON2011 conference in February there were two sessions of topical relevance to the committee. The first, titled "Real Estate Restructurings: The Issues and Challenges Raised by Complex Multi-tranche Structures," covered topics such as commercial mortgage-backed securities, mezzanine loans and "bankruptcy remote" entities. James M. Lukenda of Huron Consulting Group in New York served as the session's Presiding Officer, and Marcia L. Goldstein of Weil, Gotshal & Manges, LLP in New York moderated the session. The panel included Ronen A. Bojmel of Miller Buckfire & Co., LLC in New York; Gregory A. Cross of Venable LLP in Baltimore; and Hon. James M. Peck of the U.S. Bankruptcy Court (S.D.N.Y) in New York.
Real Estate Restructurings: The Issues and Challenges Raised by Complex Multi-tranche Structures
The second session was titled "Dealing with Appraisals and Comparables in a Volatile Market," and offered a diverse set of charts and graphs while discussing comparables, scrutiny and relevance of appraisals, and insufficient means of analysis. This session was moderated by Curtis Burr of Burr Pilger Mayer, Inc. in San Francisco. The panel included Anthony V. Aaron of Ernst & Young LLP in New York and Dr. Adam Borison of NERA Economic Consulting in San Francisco.
Dealing with Appraisals and Comparables in a Volatile Market
At the recently concluded 35th Annual Judge Alexander L. Paskay Seminar on Bankruptcy Law and Practice there was a session of interest to the committee titled "Mortgage Foreclosure Meltdown: Flawed Affidavits, Improper Securitization and Breaks in the Title Chain." The panel focused on the Mortgage Electronic Registration System (MERS) and discussed cases that favored and those that faltered under MERS. The panel included Brad J. Axelrod of McGlinchey Stafford, PLLC in Baton Rouge, La. and Matthew P. Weidner of the Law Offices of Matthew P. Weidner in Tampa.

There was a session of interest to the committee at the recent Bankruptcy Battleground West Conference that was held on March 4th in Los Angeles. Panelists in the session "The Reorganizing (and Unraveling) of Real Estate Enterprises" discussed the NAMCO case, while touching on topics such as LLC debtors, promissory notes, a holder in due course and appraisal issues. The session was moderated by Aleksandra Zimonjic of Landau Gorrfried & Berger LLP in Los Angeles. The panel included Dennis B. Arnold of Gibson, Dunn & Crutcher LLP in Los Angeles; J. Michael Issa of GlassRatner Advisory & Capital Group LLC in Irvine; Bradley D. Sharp of Development Specialists, Inc. in Los Angeles; David B. Shemano of Peitzman, Weg & Kempinsky LLP in Los Angeles; and Hon. Laura S. Taylor of the U.S. Bankruptcy Court (S.D. Cal.) in San Diego.
