An issue that frequently arises in connection with the retention of investment bankers in chapter 11 cases is whether an investment banker can be retained under §328(a) of the Bankruptcy Code, and if so, what standard of review is applicable to the fee arrangement, including any success fee arrangement.

  • The popular Bankruptcy - Nuts & Bolts for Young Practitioners program, which was filled to capacity at ABI's Annual Spring Meeting, is available online! An outstanding faculty of judges and practitioners, led by ABI Resident Scholar David G. Epstein, will explain the fundamentals of bankruptcy, covering: structure of the Code; concepts such as discharge, property of the estate, claims, priority, adequate protection; automatic stay and exceptions; avoiding powers, fraudulent transfers, preferences; executive contracts and leases; and chapter 11 from beginning to end. Faculty bios are available online. The cost for this program is $295 (special prices are available for government employees) and CLE credit is available in some states.

  • Bankruptcy Telecommunications Manual, is available through the online publications catalog. Written by Debra Grassgreen of Pachulski, Stang, Ziehl, Young, Jones & Weintraub PC, this book addresses the basics of first-day motions and provides an overview of administrative, operational and substantive motions/orders. First-day Motions: A Practical Guide to the Critical First Days of a Bankruptcy Case and a variety of other titles are also available through the online publications catalog.
