European Law on Cross-border Insolvencies: Status of French Practice After
the E.U. Regulation

The EC Regulation1
on insolvency (Regulation) went into effect in May 2002 in all E.U. member
states except for Denmark. The rules contained in the Regulation will
have a significant impact on French practice in cross-border insolvency
cases, especially in that the courts may have jurisdiction to open a main
insolvency proceeding against a legal entity domiciled in the European
Union.

Committee to Host Joint Meeting with Finance and Banking
Committee at 2004 Annual Spring Meeting
The International
Committee and Finance
and Banking Committee will host a joint panel to examine the fraud
and bankruptcy of Sarbanes-Oxley at the 2004
Annual Spring Meeting. The joint panel will address the practical
implications of Sarbanes-Oxley for auditors, financial institutions
and practitioners. The panel will explore the impact of S-O's
reporting and bankruptcy provisions in the context of a chapter 11 restructuring
and will address issues similar to those raised in the Trauger
case pending in the N.D. Cal. (Trauger is accused of knowingly altering
the electronic and hard records, workpapers, and financial statements
of a financial institution now in chapter 11 while he was a partner at
an international accounting firm).
The following
speakers are slated for the presentation:
- Jean Fitzsimon of Bridge Associates (New York), who is also the head
of the regulatory affairs committee of the ABA and has extensive experience
in the general subject.
- Joe McLaughlin, who before joining Heller Ehrman (New York) was chairman
of the CSFB Foundation Trust after spending several years as the Executive
Vice President of Legal and Regulatory Affairs at Credit Suisse First
Boston, overseeing international legal and compliance issues in 60 countries.
- Stephen Taylor, PricewaterhouseCoopers LLC (London)
- Josefina Fernandez McEvoy will serve as moderator.
